about how the white house may be trying to convince defense contractors not to send layoff warnings to workers before next month's election. the office of management and budget sent a memo last week saying the government could cover the cost that companies would face if they run into legal troubles for not properly warning those workers. here's the federal law and what it says. it says that companies with 100 or more workers must provide 60 days notice before mass layoffs or plant closings, or those workers can get up to 60 days of back pay if they are not notified. the republicans are crying foul and eamon javers picks under the story. >> reporter: here's what the omb said in late september -- it is neither necessary or appropriate for federal contractors to provide warn act notice to employees 60 days in advance of the potential sequestration because of the uncertainty about whether sequestration will occur. i've toualked to employees at t white house and omb about this question. their idea is this -- first of all, there's uncertainty about the fiscal cliff itself, whether it is a

bought that facility, we're told not with money from the defense department, instead the funding is apparently coming from the justice department. congress, by the way, not involved, and some say this is an end run that while it's not illegal in any way, it is highly unusual. in 2009 president obama did send a memo to both the justice and defense d.s to arrange for ownership of the facility and prepare to take on federal prisoners, possibly some from guantanamo bay. a number of republican lawmakers, chief among them congressman frank wolf from virginia, led efforts to block the use of federal dollars so it couldn't be bought. wolf has also said he does not trust the defense department not to send gitmo prisoners to how thompson. senator dick durbin's office confirms the sale. you mentioned the amount, $165 million, and apparently this is a direct deal between the federal government and illinois meaning congress is not involved. durbin's office also says today that gitmo prisoners are not going to be located at this facility. that is the official word. we're working to conform mor

that the economy is at risk for falling off. part of that includes the deep defense cuts. so concerned about these cuts, yet we are calling for additional regulatory costs. it is like again getting back to the priorities. these are troubling times. >> we have our priorities all wrong. the defense cuts are very bad policy. secretary of defense has said is the hall of the u.s. military and heard his readiness and ability to defend our nation. that's a terrible idea. we are now finding a more and more about the sequester. the law says that if you're going to cut the defense spending and lay off workers the contractors have to give those workers 60 days' notice. that would have come before the election. conveniently department of labor says you don't have to send out those notices. today we found that the administration said that those same contractors guy if you don't send out a notice and get sued we will pay all legal costs. now the taxpayer is going to be on the hook for the compensation and legal costs because everyone will see knowing that the money is there. lori: so, with reference to th
